Why Uber Accidents are Different
A crash involving an Uber isn’t the same as a regular car accident. Unlike typical accidents, there are multiple layers of responsibility. The good news is that your car accident lawyer in Columbia will determine liability and pursue accountability on your behalf.
However, it doesn’t hurt to familiarize yourself with the upcoming process and all possibilities. For instance, the driver may have personal auto insurance, the Uber company might have commercial coverage, and other drivers on the road could be partially at fault.
In general, these accidents happen for a variety of reasons:
- Driver distraction, often from navigation apps or ride requests
- Sudden lane changes in crowded streets
- Intersection collisions, where someone fails to yield
- Highway merges, where speeds are higher and reaction time is shorter
- Pedestrian or cyclist impacts near pickup and drop-off zones
Even a low-speed accident can result in major injuries due to the nature of sudden stops, seatbelt restraints, and vehicle design. Victims often face not only physical trauma but also financial uncertainty, especially when insurance responsibility is unclear.
Understanding Fault in South Carolina
South Carolina is an at-fault state, meaning the person responsible for causing the crash is also liable for damages. But with Uber, the process of determining fault isn’t always simple.
Your personal injury lawyer in Columbia will have to consider whether the driver was on the app, waiting for a ride, or actively transporting a passenger at the time of the collision.
Each scenario can affect which insurance policy goes into effect :
- App off: The driver’s personal policy typically governs.
- App on, waiting for a ride: Uber’s contingent liability policy may cover the accident.
- Ride accepted or passenger on board: Uber’s primary commercial insurance policy usually applies.
Since multiple policies may overlap or conflict, proving liability is often more complicated than usual. Evidence such as dashcam footage, app records, witness accounts, and police reports becomes very important when striving to establish the chain of responsibility.
Common Injuries From Uber Collisions
Ask any Uber accident attorney in Columbia, and they will likely tell you that the physical toll of an Uber crash can be disastrous, even at lower speeds. Many victims experience injuries that aren’t immediately obvious, which leads to delayed medical attention and prolonged recovery.
For instance, these are injuries commonly sustained by victims of these incidents:
- Whiplash and neck strain, caused by sudden impacts
- Head trauma, including concussions or more severe traumatic brain injuries
- Back and spinal injuries, which can have long-term effects on mobility
- Fractures, particularly in arms, legs, and ribs
- Internal injuries, sometimes hidden at the scene
- Emotional trauma, including anxiety or post-traumatic stress
These injuries often have lasting effects. Medical bills, missed work, and ongoing rehabilitation can put a lot of financial strain on victims as well as their families. This is why clarity about insurance and liability is so important.

The Insurance Maze After a Crash
After an Uber accident, victims often face multiple insurance companies: the driver’s personal insurer, Uber’s corporate policy, and possibly third-party insurers. Each of these options might attempt to minimize your payout or delay your claims.
These are complications your Columbia Uber accident lawyers can help you with:
- Disputes over which policy applies, depending on whether the driver was on the app
- Insurance adjusters questioning the severity of injuries, without full medical records
- Negotiations involving multiple parties when other drivers or pedestrians were involved
- Potential coverage gaps, leaving victims responsible for out-of-pocket expenses
This insurance complexity can make it difficult for victims to get timely compensation, and delayed settlements can exacerbate financial and emotional strain.
Statute of Limitations in South Carolina
In South Carolina, victims have three years from the date of the collision accident to file a personal injury claim. This timeline applies whether you were a passenger, driver, or third-party victim.
For wrongful death claims, the same three-year window applies, though it goes into effect on the date of the death rather than the day the crash occurred. Waiting too long can jeopardize your ability to recover damages.
Even if you’re negotiating with an insurer, the statute of limitations continues to run, making timely action a must. Call Uber accident lawyers in Columbia as soon as possible.
