What is Doctor Sexual Abuse, and How Does it Occur?
Doctor sexual abuse happens when a medical professional takes advantage of their position of trust to engage in inappropriate, non-consensual, or harmful sexual behavior toward a patient.
Examples of Doctor Sexual Abuse
Sexual abuse in a medical setting can take many forms. Some examples include:
- Unnecessary or inappropriate touching during an exam
- Sexual comments or advances that make a patient uncomfortable
- Performing exams without proper consent
- Pressuring or forcing a patient into sexual activity
- Taking or sharing inappropriate images of a patient
- Exploiting a patient’s medical condition or vulnerability to engage in sexual misconduct
If you have experienced any of these situations—or anything else that feels wrong—you may have a case. You deserve to be heard, and you deserve justice.
Why Medical Abuse Cases are Challenging but Necessary
Doctor sexual abuse cases are often complicated because of the power imbalance between doctors and patients. Medical professionals may use their position, reputation, or influence to avoid accountability.
- Survivors may feel pressured to stay silent. Some fear no one will believe them or worry about retaliation.
- Doctors may hide behind medical explanations. They might try to justify their actions as part of a procedure.
- Hospitals and medical institutions may try to cover it up. Many organizations prioritize their reputation over protecting patients.
Despite these challenges, bringing these cases forward is important—not just for the survivor but to help prevent further abuse.
At John Foy & Associates, our Augusta personal injury lawyers are committed to holding medical professionals and institutions accountable and ensuring they acknowledge the harm they have done and take responsibility.

Who Can Take Legal Action for Doctor Sexual Abuse in Augusta?
If you have suffered abuse by a doctor, you have the right to file a civil claim. In some cases, family members of a survivor—such as parents of a minor child—may also have legal standing to pursue damages.
It’s important to know that these cases are not just about money—they are about holding people accountable and making sure this doesn’t happen to someone else.
What Damages Can You Recover in a Doctor Sexual Misconduct Case?
Doctor sexual abuse can cause long-lasting physical and emotional harm. A legal claim can help survivors recover damages such as:
- Medical expenses for any treatments related to the abuse
- Therapy and counseling costs to help with emotional recovery
- Pain and suffering for the trauma experienced
- Loss of income if the abuse impacted your ability to work
- Punitive damages in cases where the doctor’s actions were especially egregious
We know that no amount of money can erase the pain, but a successful case can help with healing and closure while holding those responsible accountable.
We Must Meet Time Limits for Filing Your Lawsuit in Georgia
Under Ga. Code § 9-3-33, most personal injury claims must be filed within two years from the date of the incident. However, sexual abuse cases may have longer deadlines depending on the circumstances:
- For survivors who were minors at the time of the abuse, the deadline to file a lawsuit extends beyond the standard two-year period.
- Recent changes to Georgia law allow more time for survivors of childhood sexual abuse to pursue legal action.
Every case is unique. Even if you think the deadline has passed, talk to our attorneys handling doctor sex abuse cases in Augusta. There may still be legal options available.
What to Do if You Experience Sexual Abuse at the Doctor’s Office
Experiencing sexual abuse from a doctor or healthcare professional is a deeply violating and traumatic event. You may feel shocked, confused, or unsure about what to do next. Your feelings are valid, and you have the right to take action.
Here are some steps you can take to protect yourself and begin seeking justice:
Get to a Safe Place
If you are in immediate danger or feel unsafe, leave the situation as soon as possible. If you need assistance, ask a trusted friend, family member, or another medical professional for help.
Trust Your Instincts
If something felt wrong, it probably was. Doctors and medical professionals should always explain what they are doing and why. You do not have to stay silent or accept their behavior if it made you uncomfortable or violated your boundaries.
Write Down What Happened
As soon as you feel ready, document what happened in as much detail as possible. Include:
- The date, time, and location of the incident
- The name and title of the medical professional involved
- Any comments or actions that made you feel uncomfortable
- Any witnesses (such as nurses, staff, or family members present)
This information can help if you decide to file a report or take legal action.
Report the Abuse
You can report the abuse to multiple places, depending on what feels right for you:
- Law enforcement: If a crime was committed, you can file a police report.
- The medical board: You can report the doctor to the Georgia Composite Medical Board, which licenses and oversees physicians.
- The hospital or clinic: If the abuse happened in a hospital or medical practice, reporting it can help protect other patients.
- An attorney: A legal team can help guide you through your options, even if you are unsure about pressing charges.
Seek Support
You do not have to go through this alone. Consider reaching out to:
- A therapist or counselor who specializes in trauma
- A trusted friend, family member, or support group
- An advocacy organization that helps survivors of sexual abuse
