All too often, victims of car accidents don’t realize how much their injuries will end up costing them. Many seemingly minor injuries, like a fractured bone or whiplash, can develop into chronic injuries and long-term pain. More serious injuries can be life-changing and may leave you with bills running into the hundreds of thousands of dollars.
You have to be sure you will get the full amount of money you need to cover your medical costs and other expenses. A Loganville personal injury lawyer can help you.
John Foy & Associates has over 20 years of experience winning cases for car accident victims. We have built our firm up from a small local law office to one of the most respected names in personal injury law. Call us and let us give you a free, no-obligation consultation on your case.
Who Is At Fault in a Car Accident in Loganville?
Georgia is an at-fault state for car accidents. That means that whichever driver caused the accident is held responsible. They or their insurance company must pay all the costs of everyone involved in the accident. But the process used to determine who is at fault is not always transparent.
In some cases, the person at fault is obvious. Drunk drivers, distracted drivers, and anyone breaking the rules of the road will typically be held at fault for the accident. But there are exceptions, and there are many cases where it’s much harder to see who was ultimately to blame.
The key in many cases is “negligence.” If the other driver was negligent, it means they were careless, and their carelessness led to the accident. They may not have been doing anything malicious, but if they had been more careful, everyone would still be in full health.
No matter what, don’t let the insurance company try to turn the blame around on you. Insurance companies will use a variety of tactics to try to get you to give up your claim or accept too small of a recovery. In some cases, we have seen car accident victims who thought they had no case at all and then went on to win $100,000 or more.
What If I Was Partially at Fault for My Crash?
If you had any fault in your car accident, it could affect how much compensation you get from your claim. Georgia uses the modified comparative negligence rule, which means, if you had less than 50% of the fault in your crash, your compensation can be reduced according to your negligence.
This is due to the Official Code of Georgia Annotated (OCGA) §51-12-33, which states, “the judge shall reduce the amount of damages otherwise awarded to the plaintiff in proportion to his or her percentage of fault.”
For example, if you were 20% at fault for your accident–maybe you were looking at your phone or speeding and may have avoided an accident as severe as what happened–your compensation can be reduced by 20%. That means a payout that would be $10,000 would be reduced to $8,000.
The comparative negligence rule is a big reason why having a skilled car accident attorney in Loganville by your side is a huge help. An experienced car accident lawyer in Loganville will know how to gather evidence and argue that you were not negligent at all in your case so you can get every cent that you’re owed.
What Is the Average Settlement for a Car Accident?
Because every car accident is different, there isn’t any “average” number that will help you understand how much compensation you could get from your settlement. Injuries can range from minor to severe and from easily treatable to long-lasting. The factors surrounding your case will affect how much you receive.
The best way to find out how much you stand to get from your claim is to talk face-to-face with a car accident attorney in Loganville. A member of our team can assess your case and give you a good idea of the compensation that may be available for your damages.

What Kind of Damages Can I Recover After a Car Accident in Loganville?
Accident victims in Loganville can recover up to 100% of all costs related to the accident. In other words, if you were injured and the accident wasn’t your fault, you should be able to move on without a single dollar or debt or costs.
We can help you recover money for many types of damages, including:
- Medical costs
- Medication
- Physical therapy or occupational therapy
- Lost wages related to the accident
- Car repair costs
In some cases, you may be entitled to much more. If you have suffered a disability or a serious injury because of your accident, you could be awarded a substantial dollar amount in addition to the costs above. This money cannot undo what happened—nothing can. But it can help you and your family emerge from your accident without financial strain.
How do I Know If I Really Have a Case?
The only way to know is to get a professional opinion from someone who understands the law. In general, however, never doubt your claim or second guess what you know happened. The insurance company will try to get you to accept blame or take a much smaller amount than you deserve. But simply having a lawyer representing you can dramatically change their story.
While every case is unique, we’ve won financial recoveries for our clients in many types of cases:
- Head-on accidents
- Rear-end accidents
- Accidents involving fog or rain
- Distracted driver accidents
- Drunk driver accidents
- Faulty tires
- Whiplash and neck pain
- Hit and run accidents
- Uninsured drivers
No matter what happened in your accident, as long as someone else was at fault, you could be able to get well-deserved money for your damages. Don’t hesitate to talk to a personal injury lawyer about your case today.
Do I Have to Go to Court for My Loganville Car Accident Case?
It’s not common. Occasionally the insurance company simply won’t negotiate. In those cases, we will make a recommendation to you of whether your case should go all the way to the local courts. We’ll make this recommendation based on how likely we think you are to win. If you do go to court, we’ll handle all the details for you.
More often, however, you will never need to go to trial. At John Foy & Associates we have earned the nickname “the Strong Arm law firm.” This is because we are merciless at the bargaining table, and we will not tolerate any tricks or misleading statements from the insurance company.
We can often push them to pay you the full amount you deserve, without ever seeing the inside of a courtroom. Our car accident lawyers in Loganville have years of experience negotiating with insurance companies.
What does It Cost to Hire a Loganville Car Accident Lawyer?
We don’t think hiring a car accident lawyer should cost you anything out of pocket.
We have seen some law firms charge up-front fees to their clients or high hourly rates. We don’t follow this practice, because we don’t think it’s fair that your lawyer gets paid unless they win your case. That’s why we offer a different payment structure:
- Every consultation is FREE.
- You pay NOTHING out of pocket.
- We only get paid if we win you money.
If we successfully bring you a financial recovery, we take our fee as a percentage and everything else goes to you. That makes the entire process risk-free for you.
