How a Stone Mountain Child Injury Attorney Can Help
When you think of a lawyer, you might imagine a movie character arguing in front of a judge. The truth is that that is just a small part of an attorney’s job. Instead, when you hire a Stone Mountain child injury attorney, they will handle every step of your claim to make sure that your child receives the best treatment and that you get compensated for it.
To do that, your attorney will:
- Investigate your child’s accident
- Gather evidence of the at-fault party’s negligence
- Calculate the full extent of your damages
- Negotiate with the other party and their insurance company
- Fight for you in court in the rare event that your claim goes to trial
There’s a very good chance that the at-fault party’s insurance company will be who you’re contending with to get your compensation. They want to save money, which means they’ll do anything in their power to reduce the compensation you get. That can include tricking or bullying you into accepting less than you’re owed.
That’s why it helps to have a child injury attorney in Stone Mountain to protect you from people who want to take advantage of you. A lawyer will know exactly what to say and do to give the insurance company as little ammo as possible and get you the best settlement possible.
What to Do If Your Child Is Injured in a Car Accident
If your child is injured in a car accident, your first priority should always be their safety. Make sure they aren’t in a dangerous location and get medical attention as soon as possible. Even if their injury seems minor, if it goes untreated, it could become more serious with time.
There are also some things you can do at the scene of the accident and in the days following the crash to help your personal injury claim. After your child is injured in a car accident, you should:
- Call the police and get an accident report. That will be essential for your injury claim.
- Gather any evidence you can, such as pictures of the damage done to your car and your child’s injuries
- Get the other driver’s information, including their contact information and insurance details.
- Follow up on recommended treatment and keep all documents you get from the doctor
- Don’t tell the insurance company anything they don’t need to know without talking to an attorney first.
The sooner you contact a child injury lawyer, the sooner they can get to work on your case and ensure that you don’t get taken advantage of.
Can I Sue My Child’s School for an Injury?
This is a complicated matter. The Official Code of Georgia Annotated (OCGA) § 36-1-4 states that the county and its employees can’t be sued in most cases (also known as sovereign immunity). That goes for schools, too. Unless there is a specific situation in which a statute states otherwise, you can’t sue a government entity for your child’s injury.
However, there is one unfortunately common situation in which a personal injury claim could be possible: school bus accidents. If your child was injured because of the negligence of a school bus driver, the school district could be liable for your damages up to the amount of insurance that the county carries.
A school injury is complicated to get compensation for, but not impossible. With a skilled and experienced child injury attorney in Stone Mountain, you could be able to hold at-fault school districts or employees accountable.
