Medtronic is continuing to shell out major cash for liability lawsuits related to their Infuse device. They are paying $22 million to settle around 1,000 claims and is setting aside up to $140 million for future claims. Around 1 million people have received the device, many for off-label purposes.
For more than a decade, people have reported problems with this device. But conflicts of interest kept knowledge about the problems from the public. A group of surgeons co-authored papers to deny links to the product and several severe complications including sterility and cancer. A later review in 2011 from other doctors rebuked these papers.
Meanwhile, the U.S. Senate Committee on Finance also did an investigation and found that Medtronic employees were involved in the drafting and editing of favorable articles about the product and paid millions of dollars to the surgeons who authored the original papers denying problems. Over 15 years, Medtronic paid $210 million in payments to doctors. Many of the lawsuits allege that the doctors illegally promoted Infuse for off-label uses due to these payments.
However, the company is denying that they have done anything wrong or that their product is defective. They are calling the money they set aside a compromise in the face of so much litigation.
