Sometimes an auto accident can have tragic consequences like the serious death or injury of other passengers in your vehicle or passengers in other vehicles. Regardless of the fact that these situations are almost always accidents, sometimes people must be held criminally liable. The Gwinnett Daily Post reports on a man who was arrested in connection with an automobile accident that claimed the life of a 9-year-old girl.
28-year-old Andrew Elsberry was arrested at the scene in connection with an accident that occurred on Ga. Highway 316 last Thursday.
According to the Gwinnett County Police, Elsberry was following the direction of his GPS as he drove his Dodge Ram 3500 in the left-hand lane down Highway 316. His GPS warned him that traffic on Interstate 85 was heavy. To avoid the heavy traffic, he should get off at the next exit instead. This would necessitate that he merge all the way over to the right.
Elsberry looked over his shoulder to see if the path was clear to merge. When he brought his gaze back forward, the Dodge Caravan in front of him was stopping. The Gwinnett County Police report indicates that Elsberry said he was unable to stop in time and struck the rear end of the caravan.
This crash pushed the Caravan into the Toyota Corolla that had been slowing down in front of the van. In addition, a Nissan Sentra driving behind Elsberry said that no brake lights came on and she collided with the trailer that Elsberry had been towing.
The driver of the Corolla and the Sentra refused medical treatment. The driver of the Caravan was taken to Gwinnett Medical Center with undisclosed injuries. 9-year-old Ceceilia Powell had been sitting in the third-row seats in the back of the caravan. She suffered life-threatening injuries and later succumbed in the hospital.
Police arrested Elsberry at the scene. He was charged with following too closely and homicide by vehicle in the second degree.
