You may remember a few years ago when a student at FAMU died in a hazing ritual. The family is still pursuing a lawsuit against the university about that case. The lawyers for the family have made an offer to FAMU and the State of Florida that they will settle the case for $8 million.
FAMU has been placed in a difficult position because of the case. They are a publicly funded university. Any settlement offer they accept has to pass the Florida Legislature since the settlement money would come out of taxpayer pockets. They have 30 days to decide on whether or not to accept the proposed settlement.
The university has been arguing that the student voluntarily participated in the hazing ritual back in 2011, and thus the university should not have any liability in the case. Also, by participating in the ritual, the student violated state law.
Laying down a settlement agreement is like laying down an ultimatum. Accept the offer or we will see you in court. Often a settlement offer will come from the person or entity being sued, but it can come from the plaintiffs as well as in this case. It takes a skilled personal injury attorney to judge what the most advantageous legal strategy is in any particular case.
