Liability for a Grubhub car accident varies. A Grubhub driver, the food delivery company, or another party may be at fault. To determine who is liable for a Grubhub car accident, consult with a car accident lawyer in Atlanta.
A lawyer will review your accident and identify any liable parties. Next, they will explain your legal options in detail. If you want to get damages from anyone responsible for your accident, they can help you file an insurance claim or personal injury lawsuit.
How Can I Determine Who Is Liable for a Grubhub Car Accident?
Work with an Atlanta car accident lawyer to determine liability. Someone can be held responsible for your Grubhub accident if they were negligent. To prove this point, you will have to show that this party had a duty of care, violated this legal obligation, and caused your accident and damages.
For example, a Grubhub driver is more focused on making their next delivery than traveling safely from point A to point B. This driver gets distracted, crashes their car into yours, and you get injured. Within days of the incident, hire a Atlanta distracted driving accident lawyer to represent you and prove that you got hurt due to a Grubhub driver’s negligence.
Saying someone is liable for your accident is not enough to secure damages. You will need evidence to support your claim. With your lawyer’s help, you can use accident scene photos, videos, and other proof to show another party is at fault.
What Should I Do if Someone Else Is Liable for My Grubhub Car Accident?
Partner with an Atlanta car accident attorney so you can seek damages from any liable parties. Your lawyer knows it is difficult to get over a car accident that was not your fault. They work diligently to pursue compensation that you can use to recover from your accident.
Your attorney can request damages in accordance with Georgia’s statute of limitations. After a Grubhub car accident, you have two years from the date of the incident to ask for damages. Your lawyer can submit your claim promptly and build an argument designed to prove you deserve 100% of the compensation you are requesting.
In your case, you could get damages from a liable party or their insurance company. The at-fault party could have auto insurance that will give you compensation for your losses, or they could be covered under Grubhub’s insurance policy if they were working for the company at the time of your accident. Alternatively, you can file an injury lawsuit.
What Should I Do if Someone Claims I Am Liable for a Grubhub Car Accident?
Have an Atlanta personal injury lawyer contest the claims against you. Together, you and your lawyer can prepare an argument that proves you are not responsible for your Grubhub car accident. Your lawyer also understands the modified comparative fault rule and will explain how it applies to your case.
In Georgia, multiple parties can be responsible for an auto accident. If you share responsibility for your Grubhub car accident with someone else, you can still collect damages. However, you are ineligible to get damages if you are primarily at fault for your accident.
For instance, a judge or jury rules you are 20% liable for your Grubhub car accident. The defendant in your case is ordered to pay 80% of your damages, and you cover the rest. On the other hand, if you are 51% at fault, you are more to blame than the other party and cannot recover damages from them.

Should I Accept a Settlement from Someone Liable for a Grubhub Car Accident?
If you receive a settlement offer from the party responsible for your Grubhub car accident and believe the proposal is reasonable, it may be best to accept it. Before you do, meet with a lawyer. They can evaluate a proposal with you and help you determine if you are receiving a fair settlement for your injuries.
Account for your economic and non-economic damages. You can recover damages for your medical bills, lost income, pain and suffering, and other quantifiable and subjective losses. Consider these damages carefully as you decide whether to approve a settlement offer.
Of course, a liable party’s insurance company will likely prioritize its best interests over yours. If an insurer proposes a settlement, it may do so in the hopes you accept far less than what your case is worth. Your lawyer understands what is occupational accident insurance from Grubhub and other topics relating to your case, and they work hard to get you the damages you deserve.
