The DePuy hip recall covers two different hip replacement systems that have been in use since 2003, but have caused numerous problems for patients. The parent company, Johnson and Johnson, is in the middle of litigation over lawsuits involving the products.
DePuy Hip Recall
The DePuy hip recall actually covers two different hip replacement products produced by the pharmaceutical company, DePuy. These two products include the DePuy ASR system which is used for hip resurfacing as well as the ASR xl Acetabular System. There have been numerous problems surrounding these two types of hip implants, and the problems have been enough to cause DePuy to release the recall.
The reasons for this recall have to do with malfunctions. Since the implants started being used in the early 2000’s, more than ten percent of patients have had to undergo follow-up surgeries to make repairs to the original implants. These faulty implants have resulted in great cost, pain and injury to the patients with one of the two systems.
For those patients who do have one of these hip systems, most cases are being settled. This is good news since it equals a much better chance of compensation. Of course, a settlement can vary depending on each patient. If the patient has already had to undergo repair surgery, then the settlement can be significantly higher than for those who have not yet had any problems from their hip replacement systems. This does not mean that a person who has not yet had problems with the replacement should not get compensation.
Because litigation is still ongoing in these cases, DePuy has not yet settled any cases. This does not mean that settlement will not happen. Instead, it means that it is still too early in the ongoing process, which is being litigated by parent company Johnson and Johnson, to give an exact dollar amount that victims will receive.
The two different types of the DePuy implants, the ASR resurfacing system and the ASR xl Acetabular system went into use by orthopedic surgeons in 2003. Since that time, more than 90,000 hip replacements were done using these two systems. While only 10 percent of patients have needed corrective surgery, more and more patients are beginning to have problems with their hip replacement on a daily basis.
