The Kugel Mesh Patch was released by Davol, Inc as a method of repairing post surgery hernias. However, the makers of the patch were aware of a serious malfunction that has resulted in injury and death. The FDA has recalled the patch and numerous lawsuits are in litigation.
Hernia Patch Warning
Hernias are a fairly common side effect of surgeries to the abdomen area. After the surgery, the abdominal wall is left weakened, and then the muscles herniate out through the wall, and this can be quite painful. It requires another corrective surgery. Starting in 2002, the Kugel Mesh Patch was used in this corrective surgery. The patch was approved by the FDA in 1996 and was distributed by Davol, Inc. This patch is designed to help hold organs into place so that the patient does not continue to suffer from hernias.
However, problems began to come about as early as 2005 when a new model of the patch was released. The patch, which was released as a larger, more efficient version by Davol, Inc., had a very serious side effect due to a malfunction. The design of the mesh includes a metal ring, which is supposed to spring into place when placed within the body. However, a defect causes the ring to come apart where it is joined together. When the ring breaks, the side effects can be severe.
Patients who have a broken Kugel Mesh Patch could suffer from sepsis, severe pain, bowel perforation, organ perforation, damaging fusion of organs, and even death. Because of these severe side effects, the FDA has released a recall of the Kugel Mesh Patch. The recall is listed as class one and this means that not only should the patch no longer be used, but also any patients who currently have the patch should have it removed as soon as possible. The FDA determined that numerous patients have had severe side effects from the patch, and there has been at least one death from it.
The FDA recall involves all types of the Kugel Mesh Patch that have either broken through the metal ring or that have adhered to the patient abdominal wall, causing sepsis or organ damage.
According to FreeAdvice.com, there have been two major lawsuits against Davol, Inc. One of which involved a 52-year-old man by the name of Chris Thorpe, who suffered numerous abdominal injuries and had to undergo several corrective surgeries. Thorpe, according to the site, was awarded $1.5 million dollars in compensation. There are more than 1,000 lawsuits of this type currently in litigation.
