A medication used to treat osteoporosis, Fosamax has come under fire for causing the debilitating condition called osteonecrosis of the jaw, or more commonly known as jaw death. Lawsuits against the makers of the medication, Merck Pharmaceuticals, have led to multimillion dollar payouts.

Fosamax is a medication produced and distributed by Merck Pharmaceuticals as a treatment for osteoporosis. Made from the drugs called alendronic acid and alendronate sodium, Fosamax has been on the market for numerous years. However, the patent on the medication expired in 2008 and numerous generics have been released for the medication. The generics are owned and distributed by Barr and Teva Pharmaceuticals.
In 2000, the FDA had to start an investigation into Fosamax because of a specific side effect reported to do with the jaw. More than two hundred reports have been made of the condition and the FDA did an in-depth study of the medication. While Fosamax has not been recalled or pulled from the market, the Food and Drug Administration has required that the makers of the medication include a serious warning that the risk of osteonecrosis of the jaw is exponentially higher in patients that take the medication.
Osteonecrosis of the jaw, often referred to simply as ONJ, is a condition usually only seen in cancer patients. This condition leads to the death of the jaw over a period of time. During this time, the bones of the jaw actually die. As time goes by, the soft tissue in the mouth, face and jaw, will also die, leading to complete exposure of the dead jaw bone within the mouth. Usually, teeth and gums are lost too. There is no cure for the condition and it is very painful. While the makers of Fosamax indicate that they do not believe the medication causes ONJ in otherwise healthy people, it seems that the courts would disagree.
So far, hundreds of people who have contracted ONJ from using Fosamax have been compensated for this very serious condition. In fact, several keynote cases have paid in the millions. According to Natasha Singer, reporter for the New York Times, a 67-year-old lady in Manhattan was awarded $1.5 million in compensation. There are now more than 1,000 lawsuits against Merck from users of Fosamax who have contracted the ONJ condition.
